These conditions of sale are concluded on the one hand by the company ELEAMOI whose head office is located at 24a route de soufflenheim 67500 Haguenau, SIRET 90250256600018 and managing the website www.eleamoi.com, hereinafter "the seller" or "the company", and on the other hand, by any natural or legal person making a purchase via the website, hereinafter "the buyer" or "the customer"
Article 1 - Subject:
These General Conditions of Sale (GTC) aim to define the contractual relationship between ELEAMOI and the buyer, and the conditions applicable to any purchase made through the website www.eleamoi.com. ELEAMOI reserves the right to modify these at any time by publishing a new version on its website. The applicable GCS will then be those in force on the date of payment of the order. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the cotton dream site is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity. , allowing it to engage under these GCS.
Article 2 - Products:
The products offered are those that appear on this site within the limits of available stocks. ELEAMOI reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (use, composition, etc.). The photographs are as accurate as possible but do not bind the Seller in any way. The buyer must be aware that each product is handmade, which gives it a unique character, and therefore cannot be exactly identical to the model presented in the photograph. The sale of the products presented on the site is intended for all buyers residing in countries which fully authorize the entry into their territory of these products.
Item 3 - Price:
The prices of the products sold on this site are displayed in euros (€). It is recalled that ELEAMOI having the status of micro-entrepreneur not subject to VAT, the prices are calculated and indicated without VAT, all other taxes included. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased, according to the total weight of the order.
ELEAMOI reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the buyer.
Article 4 - Payment:
The Buyer can pay for his order by credit card, via secure online payment. By providing his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order cancelled.
Article 5 - Delivery:
Shipping costs are to be paid in addition to the article. They are automatically calculated based on the weight of the order.
Deliveries are made to the address indicated on the order form, and are made by La Poste via Letter followed or COLISSIMO, delivery service with tracking, delivery without signature. Delivery times are given for information only.
The company ELEAMOI may provide the Buyer by e-mail with a confirmation of shipment of the package as well as the tracking number of the latter.
The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the company ELEAMOI. The buyer is required to check, in the presence of the La Poste employee or the deliverer, the condition of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery. If you have not received your order, you should make a complaint to the carrier: the result of the investigation as well as the tracking number will prevail and will be considered as legal proof of shipment and / or delivery.
ELEAMOI cannot therefore be held responsible in the event of late delivery, damaged or lost parcels.
Article 6 - Returns and refunds:
In accordance with Article L221-18 of the Consumer Code on the right of withdrawal, the Buyer has 14 days from receipt of his order to withdraw, if the product does not suit him. The right of withdrawal can be exercised by contacting the Company by e-mail at contact.eleamoi@gmail.com or via the "contact" section of this site. The product must be returned in its packaging, without having been used and therefore with no signs of wear. If these rules are not respected, no refund will be made. In addition, the return costs will be borne by the buyer. The refund will be made within 10 days of receipt of the returned item, by the same means of payment used as the purchase.
Article 7 - Intellectual property:
All the elements of this ELEAMOI site, whether brands, logos, products, images, videos, texts, visuals or more generally any information subject to intellectual property rights are and remain the exclusive property of the ELEAMOI Seller. No assignment of intellectual property rights is made through these GCS. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
Article 8 - Personal data:
The ELEAMOI company undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him.
